3.2 Information collected automatically

When you visit the Site, the following technical information may be collected automatically by us or by third-party services:

  • Browser type, version, and language;
  • Device type and operating system;
  • Pages visited, duration, referring URL, and exit URL;
  • Timestamps of access;
  • Performance and error logs.

This information is primarily collected by our hosting and content-delivery provider (Cloudflare) for the purposes of security, performance, abuse prevention, and basic aggregate analytics. We do not currently operate any third-party analytics product (such as Google Analytics, Plausible, or Mixpanel).

3.3 Information from third parties

When you interact with embedded third-party widgets on the Site (such as the YouTube video embeds, the Substack subscribe iframe, or links to third-party vendor sites), those third parties may collect information about you according to their own privacy policies. We do not control the data collection practices of these third parties.

4. How We Use Your Information

We use personal information for the following purposes:

  • To respond to inquiries you send us;
  • To deliver our newsletter to you, if you have subscribed;
  • To plan and schedule future consulting engagements when booking is activated;
  • To operate, maintain, secure, and improve the Site and Services;
  • To prevent fraud, abuse, and security incidents;
  • To comply with legal obligations, court orders, and lawful requests from authorities;
  • To enforce our Terms of Service and protect our rights and the rights of others.

We do not use your personal information to make automated decisions that produce legal or similarly significant effects about you.

6. Sharing & Disclosure

We do not sell or rent your personal information. We do not share your personal information with third parties except as described below:

  • Service providers and processors - we share information with companies that help us operate the Site (for example, Cloudflare for hosting and security). These providers process information only as instructed and are bound by appropriate confidentiality and data-protection obligations.
  • Third-party platforms you choose to use - when you submit our Google Form, Google receives the information you submit. When you subscribe via the Substack widget, Substack receives your email. These transfers are governed by the third parties’ privacy policies.
  • Legal compliance - we may disclose information when required by law, court order, subpoena, or other lawful request, or when we believe in good faith that disclosure is necessary to prevent fraud, protect our rights, or comply with a regulatory or judicial proceeding.
  • Business transfers - in the event of a merger, acquisition, financing, reorganization, dissolution, or sale of assets, your information may be transferred as part of that transaction. We will notify you of any change in ownership or control of your personal information.

7. Third-Party Services We Use

The Site currently relies on the following third-party services. Each operates under its own privacy policy:

When new third-party services are added or removed, this Privacy Policy will be updated to reflect the change.

8. Cookies & Similar Technologies

8.1 What cookies are

Cookies are small text files that a website stores on your device. We use cookies and similar technologies (such as localStorage and session storage) to remember your preferences and to operate certain features of the Site.

8.2 Categories we use

  • Strictly necessary - required to deliver the Site and its core features. These include the cookie that records your consent choice from the bottom-of-page consent banner. These cannot be disabled.
  • Functional - remember your preferences and interactive state (for example, plant-quiz progress stored in localStorage). No personal information is stored in functional storage.
  • Performance & security - set by Cloudflare for DDoS mitigation, bot detection, and CDN routing. These do not personally identify you to us.
  • Analytics - not currently used. If we add analytics in the future we will update this Policy and request your consent where required.

8.3 Managing cookies

You can manage cookies through your browser settings. Most browsers allow you to refuse all cookies, accept only certain cookies, or delete cookies after each session. Disabling certain cookies may affect Site functionality. For more general information about cookies, see allaboutcookies.org.

9. Data Retention

We retain personal information only as long as necessary to fulfil the purposes for which we collected it, including for legitimate business, accounting, legal, or regulatory requirements. Specifically:

  • Inquiry submissions - retained for as long as needed to respond and continue the conversation, then archived or deleted in accordance with our internal records-retention practices.
  • Newsletter subscriptions - retained by Substack on our behalf until you unsubscribe.
  • Automatic technical logs - retained by Cloudflare in accordance with its policies (typically short windows for performance and security logs).
  • Cookie consent record - retained on your device for up to 12 months from your last interaction.

10. Your Rights

Depending on where you reside, you may have the right to:

  • Access - request a copy of the personal information we hold about you;
  • Correct - request correction of inaccurate or incomplete information;
  • Delete - request deletion of your personal information, subject to certain legal exceptions;
  • Restrict or object - restrict or object to certain types of processing;
  • Portability - receive your personal information in a structured, commonly used, machine-readable format;
  • Withdraw consent - withdraw your consent at any time, where consent was the basis for processing;
  • Complain - lodge a complaint with your local data-protection authority.

To exercise any of these rights, email us at info@johnnyautoseed.com. We will respond within thirty (30) days, or sooner where required by law. We may need to verify your identity before fulfilling certain requests.

11. California Residents (CCPA / CPRA)

If you are a California resident, the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA), grants you specific rights regarding your personal information:

  • Right to know what categories of personal information we collect, the sources from which we collect it, our purposes for collecting it, and the categories of third parties with whom we share it;
  • Right to access the specific pieces of personal information we have collected about you;
  • Right to delete your personal information, subject to certain exceptions;
  • Right to correct inaccurate personal information;
  • Right to opt out of sale or sharing - we do not sell or share your personal information as those terms are defined under the CCPA;
  • Right to limit use of sensitive personal information - we do not collect sensitive personal information beyond what is described in this Policy;
  • Right to non-discrimination - we will not discriminate against you for exercising any of these rights.

To exercise any California right, email info@johnnyautoseed.com with subject line “California Privacy Request”.

12. EU / UK Residents (GDPR / UK GDPR)

If you are located in the European Economic Area, the United Kingdom, or Switzerland, the General Data Protection Regulation (GDPR) and the UK GDPR provide you with specific rights described in section 10 above. The legal bases on which we process your data are described in section 5.

You have the right to lodge a complaint with the data-protection authority of your country of residence. We do not currently maintain a European representative under Article 27 of the GDPR; for any communication, please contact us at info@johnnyautoseed.com.

13. Children’s Privacy

The Site is not directed to children under the age of 13. We do not knowingly collect personal information from children under 13. If you believe that we have inadvertently collected information from a child under 13, please contact us at info@johnnyautoseed.com and we will delete the information promptly.

For California residents under the age of 16, we do not sell or share personal information and we will not begin doing so without affirmative authorization from the minor (or, for children under 13, from the minor’s parent or guardian).

14. International Data Transfers

We operate from the United States. If you access the Site from outside the United States, your information may be transferred to, stored in, and processed in the United States or in other countries where our service providers operate. Data protection laws in these jurisdictions may differ from those in your country.

Where required, we rely on appropriate transfer mechanisms (such as Standard Contractual Clauses) to safeguard your information when it is transferred across borders.

15. Security

We take reasonable and appropriate organizational and technical measures to protect your personal information from loss, theft, misuse, unauthorized access, disclosure, alteration, and destruction. This includes:

  • HTTPS encryption for all Site traffic;
  • A Content Security Policy and other security headers configured at the edge;
  • Reliance on reputable service providers (Cloudflare, Google, Substack) for processing;
  • Principle-of-least-privilege access to any internal systems that hold personal data.

No method of transmission over the internet or method of electronic storage is one hundred per cent secure. We cannot guarantee absolute security and you transmit information to us at your own risk.

16. Do Not Track

Some browsers offer a “Do Not Track” (DNT) signal. The Site does not currently implement tracking that would respond differently based on a DNT signal because we do not operate cross-site behavioural tracking. We respect DNT signals where technically feasible and where they are unambiguous.

17. Changes to This Policy

We may update this Privacy Policy from time to time. The “Effective” date at the top of this page indicates when this Policy was last revised. Material changes will be highlighted by an updated effective date and, where practicable, an in-page notice or direct communication. Your continued use of the Site after a change constitutes your acceptance of the revised Policy.
